Welcome to our monthly governance round-up. In this edition, governance consultant Sally Stephens shares updates on the Charities Act and the Charity Governance Code, along with some exciting training opportunities for trustees.

Charities Act 2022: First stages of implementation

The Charities Act 2022 received royal assent in February and will be implemented from Autumn onwards. Many areas of this act are specific amendments to terms of the Charities Act 2011 and will only apply to a small number of organisations, but others will have a much wider impact.

This Autumn we’re looking forward to seeing:

changes to ‘cy-près powers’ for charities, which will make it easier for charities to use funds they've raised from the public
modifications to rules around paying trustees, which will make it possible for charities to pay their trustees for goods
the extension of court and Commission powers, so they can make schemes for all types of charity, not only trusts.

When the full schedule of implementation is released, we’ll share a comprehensive view of how the changes might affect your organisation.

Next steps for the Charity Governance Code

The Charity Governance Code is a practical tool to help charities and their trustees develop high standards of governance.

At the end of July the new chair of the Charity Governance Code steering group, Radjoka Miljevic, shared her first blog, where she reflected on the future of the Code. In the blog, she talks about the importance of frameworks, and the value of hearing from a wide range of voices.

Radojka also looks at the future of the Code, which will be reviewed in 2023. She shares her thoughts on key governance challenges, including:

digital and cyber concerns
our wider environment
our engagement with nature and the climate
social changes from power dynamics to wellbeing.

New guide to help you recruit young trustees

The Wildlife Trusts federation has created a brand-new guide helping organisations to recruit young trustees.

We know how important diverse trustees are in the sector. Diverse boards make better and more balanced decisions, and the equality, diversity and inclusion principle of the Charity Governance Code recommends that boards regularly assess their diversity practice.

The guide takes a step-by-step approach and includes case studies sharing the experience of some of the younger trustees at the wildlife trusts that make up the federation.

Trustees and bullying

In newly published guidance, the Charity Commission has clarified the role of trustees in cases of bullying and harassment. Trustees must establish and maintain anti-bullying policies and make sure that allegations are taken seriously and properly investigated.

Charity Commission Annual Public Meeting

The Commission will hold their Annual Public Meeting on 12 October. It will be a hybrid event in Cardiff, featuring updates from the chair Orlando Fraser and chief executive Helen Stephenson OBE.

Third Sector commissions sexual harassment survey

Fundraisers across the sector have reported sexual harassment and exploitation within their roles. So as the world returns to in-person events and meetings, Third Sector are investigating the scale of this problem.

We run regular online trustee inductions and refresher courses over two half-days. We’re also offering brand new courses on Fundraising responsibilities for trustees, and Safeguarding essentials for trustees.

Supporting good governance

We have a new course for anyone who works alongside a board to support good governance practice.

eLearning induction for trustees

We’ve launched an eLearning module for trustees. This offers trustees a low-cost introduction to their roles.

Member events

We hold regular member assembly and welcome events.
